Dispute Resolution Through Mediation and Arbitration

Did you know that mediation is generally less expensive than litigation and that mediated settlements tend to hold up over time?

Conflicts and disputes are often part of human interactions. Mediation is a civilized and confidential alternative for resolving current conflicts as well as negotiating agreements for building and maintaining future relationships. Mediation can be a cost saving, timely alternative to the competitive and usually expensive litigation arena.

We at IDR provide a customized negotiation process where the parties constructively express his/her interests and ideas to create a workable resolution to the conflict without unnecessarily compromising future interactions between the parties. Throughout the mediation process, the impartial, trained and experienced IDR professionals help the parties reach a settlement agreement that satisfies the interests of all parties.

We know that it is important that you control the outcome of the process and that you control the final settlement agreement. When parties are personally involved in finding the resolution to a dispute, they are more likely to honor the terms of the agreement and more likely to steer clear of future conflicts.

Divorce Mediation

Sometimes life doesn’t work out the way it was expected. Parties may decide that the best path for them is to separate from or divorce his/her spouse. The process of ending a marriage or a relationship, particularly when children are involved, can be filled with the fear of what the future holds, frustration at the life altering situation the parties find themselves in and uncertainty about how to pick up the pieces for yourself and, where applicable, the children. The trained and experienced professionals at IDR understand these concerns. We are committed to helping you and your (ex-) spouse through this process as painlessly and inexpensively as possible.

At IDR, divorce mediation is about you and your spouse deciding your own divorce settlement. You control the outcome of the mediation process and the final settlement agreement. When you are personally involved in defining the divorce settlement agreement, you are more likely to honor the terms of that agreement. We at IDR provide a customized mediation process where all parties can constructively express their interests and ideas to create a workable and enduring settlement.

All mediation sessions are private and confidential. Mediation sessions are held in the IDR offices or wherever the parties would prefer. No public record is made of the proceedings.

Arbitration

Arbitration is a form of Alternate Dispute Resolution where the arbitrator(s) conducts an information gathering process, which may include document exchange, briefings by the disputing parties and testimony from witnesses in order to assist him/her to arrive at a fair and equitable resolution of the dispute. At IDR, the arbitrator(s), a neutral party agreed upon by the participants in the dispute, hears and weighs the evidence presented and renders a decision. The arbitrator’s decision is generally binding on the disputing parties. During the arbitration process, the disputing parties may be represented by counsel. In many ways, an arbitration proceeding is much like litigation before a judge. However, unlike a court proceeding, which is generally public, the IDR arbitration proceeding is private and confidential. The decision rendered under binding arbitration is, like a court ruling, enforceable by the legal system.

At IDR we have certified arbitrators, fully qualified to conduct an arbitration proceeding and render a decision. With our broad and diverse personal and professional backgrounds, we have the personnel and training to provide a knowledgeable, neutral third party to bring your dispute to an equitable resolution. Whether the dispute involves family issues, business contracts, construction, real estate, insurance claims, or patent infringement, the IDR professionals are available to assist you.

Certified Divorce Financial Analysts

Certified Divorce Financial Analysts™ serve a combination role during the divorce process. They act as part tax accountant and part financial planner. At IDR, the Divorce Financial Analyst considers proposed divorce settlements and evaluates them from a net cash flow and net worth perspective today and looking ahead 5, 10, 20 or more years into the future. The IDR Divorce Financial Analyst considers these financial analyses from the view point of both parties. At IDR, the Certified Divorce Financial Analyst™ becomes part of the divorce team and provides support for the attorney and the client on financial issues.

As part of its team of professionals, IDR offers the services of a CDFA™ to its divorce clients as part of the mediation or collaboration processes. IDR’s CDFA™ is also a trained mediator and arbitrator and is an experienced professional in collaborative divorces.

The IDR professionals provide a unique blend of talents to help their clients through the emotional process of divorce. At IDR, we understand the questions, concerns and emotions that the parties are going through during the process.

Our Team

Cecilia Buck-Taylor, JD

has been practicing law for over 18 years and received her JD from Fordham University. At The Law Offices of Cecilia Buck-Taylor, P.C., she has successfully represented clients in a wide range of areas. Attorney Buck-Taylor is a certified arbitrator and a mediator and is a member of the Association for Conflict Resolution, and the Litchfield County Collaborative Divorce Group.

William Dean Taylor, P.E., CDFA™

has over thirty years of experience in business, ranging from Fortune 100 companies to high-tech start-ups. He has a Bachelors and Masters degree in Mechanical engineering and is a licensed professional engineer. An experienced executive, Bill Taylor is also a certified arbitrator, a certified mediator and a Certified Divorce Financial Analyst (CDFA™). He is a member of the Association for Conflict Resolution. He is also an associate member of the CT Bar Association.
